Clive Stafford Smith, a death row defense lawyer, claims Guantanamo Bay is a “lie” and shares his experiences representing prisoners at the notorious detention facility. Learn more about his bold stance and fight for justice.

Clive Stafford Smith, a prominent human rights lawyer who has represented numerous individuals on death row, has made a bold claim about one of the world’s most infamous detention centers, Guantanamo Bay. After visiting the prison 42 times throughout his career, Smith now asserts that the narrative surrounding Guantanamo Bay is “all a lie.”

Smith, who has spent decades fighting for justice for people imprisoned or facing execution, remains steadfast in his belief that the truth about the U.S. military detention facility in Cuba has been deliberately hidden. In a recent appearance on the This Is Actually Happening podcast, Smith revealed that despite Guantanamo’s reputation, he “loves” going there, even though he admits it is “a nightmare of a place at one level.”

The Controversy of Guantanamo Bay

Since its construction in 2002, Guantanamo Bay has been a symbol of U.S. counterterrorism efforts, housing suspected members of al-Qaeda and the Taliban, as well as individuals captured during the War on Terror. Despite its notorious reputation, Smith argues that the prison’s portrayal to the public is far from the truth.

“My whole theory is Guantanamo is all a lie,” Smith asserted. “They’ve got it all secret because they want to pretend that they’re doing something about 9/11, and if we open it up to public inspection, they will close it down because it will be too embarrassing.”

A Fight for Human Rights: Smith’s Role in Challenging Guantanamo

Smith has dedicated much of his career to advocating for prisoners at Guantanamo Bay. Over the years, he has represented 87 individuals detained at the facility, with 86 of them eventually being released. Smith’s approach is simple yet effective: by challenging the U.S. military’s claims and pushing for transparency, his legal team has embarrassed officials into releasing the prisoners.

He recalls, “We won and that’s an amazing thing.” According to Smith, the key to these victories lies in exposing the truth about whether the prisoners were being detained lawfully, an issue he has consistently addressed throughout his career.

Challenging the Lawfulness of Detention

In 2022, Smith was one of the first lawyers to challenge Guantanamo Bay’s practices by advocating for the restoration of prisoners’ habeas corpus rights—a legal process that allows detainees to challenge the lawfulness of their detention in court. This fight has been a cornerstone of Smith’s work, as he aims to ensure that prisoners are not unlawfully held without due process.

A 2023 UN report revealed that out of 780 men and boys who had been detained at Guantanamo over the past 21 years, only seven had been convicted of crimes. This statistic highlights the larger issue of prolonged detention without due process, which human rights organizations, including Amnesty International, have condemned as abuse and torture.

The Legacy of Guantanamo Bay

Guantanamo Bay has become a significant point of controversy for human rights advocates worldwide. Amnesty International has labeled the prison an “indelible stain on the United States’ history,” citing its history of abuse and torture. As of January 2025, only 15 prisoners remain at the facility, with Smith and other legal teams continuing to fight for their release.

For Smith, the battle against Guantanamo Bay is far from over. His relentless work advocating for justice and human rights continues to challenge the U.S. government’s treatment of detainees, seeking to expose the truth behind the controversial detention center.
